EHDS in (university) hospitals – An interdisciplinary discussion

The European Health Data Space (EHDS) establishes the roles of health data holders and health data users, both with certain rights and obligations. As health data holders and potential health data users, (university) hospitals have to prepare for the practical implementation of the EHDS to utilize its full potential and mitigate any risks.

This workshop aims to provide insights about these regulatory requirements and their practical challenges through a shared discussion between the medical and legal researchers of the CD-Laboratory. It does so on the basis of the concrete case study of a medical university with audience participation.

The workshop will be held in German with the possibility to discuss questions in English as well.

Questions for Discussion:

  • Health data holders mainly have to establish thorough oversight of available data sets, not only to fulfil the EHDS’s obligation of notification of such datasets but also to effectively protect possible rights on datasets through notification of the Health Data Access Body. For this, a closer examination of IP rights and trade secrets is essential.
  • Health data users have to take a closer look at GDPR provisions. They will have to comply either with the provisions about processing of personal data or with the risks associated with handling anonymized data. For this, a closer examination of anonymization and processing personal data based on Austrian research exemptions and legitimate interest are essential.
